WEBINAR 10: Competitive Procedure with Negotiation in Practice: From Requirements to the Right Solution

The INPROCAP project is building the skills and practical tools needed by organisations across the Big Science ecosystem to implement innovation procurement successfully.

The tenth webinar, titled “Competitive Procedure with Negotiation in Practice: From Requirements to the Right Solution”, is part of the INPROCAP Webinar / Training Series running from October 2025 to December 2026. The session will focus on how Big Science Organisations can use the Competitive Procedure with Negotiation when procurement requirements are sufficiently defined to launch a competition, but certain aspects of the solution or contract still need to be discussed and refined with selected candidates.

Designed primarily for procurement, legal, technical and project staff working within Big Science Organisations, the webinar will combine an expert introduction to the procedure with practical guidance and experience from real-life implementation.

In this two-hour session, participants will:

  • receive an expert overview of the Competitive Procedure with Negotiation and its main stages
  • explore when this procedure may be appropriate for complex or innovative Big Science procurement challenges
  • examine how negotiations with selected candidates can be used to refine tenders and contractual or technical aspects
  • learn about key legal, procedural and organisational considerations when preparing and conducting negotiations
  • review a practical case and discuss lessons that may be transferable to other Big Science Organisations.

By the end of this session, participants will:

  • understand the purpose, structure and main stages of the Competitive Procedure with Negotiation
  • recognise situations in which the procedure may be suitable compared with other procurement approaches
  • understand how to prepare and manage the negotiation phase while ensuring transparency, equal treatment and confidentiality
  • identify the roles of procurement, legal and technical teams throughout the procedure
  • learn from practical experience and assess how the approach could be applied within their own organisation

Session 1 – Competitive Procedure with Negotiation explained

An expert introduction to the Competitive Procedure with Negotiation, including its purpose, legal framework, main stages and the circumstances in which it may be used.

The session will also consider how this procedure differs from approaches such as Competitive Dialogue, Innovation Partnership and Pre-Commercial Procurement.

 

Session 2 – Practical case and lessons learned

Procurement challenge and organisational context

  • Why the procedure was selected
  • How candidates, initial tenders and negotiations were managed
  • What was refined through negotiation and what remained fixed
  • Results, challenges and lessons learned
  • Recommendations for other Big Science Organisations

Session 3 – Preparing and managing the negotiation process

Practical guidance on preparing the procedure, selecting candidates and organising the negotiation phase.

 

Topics will include:

  • defining procurement requirements and identifying negotiable elements
  • preparing procurement documentation and the initial tender framework
  • coordinating procurement, legal and technical teams
  • planning and conducting negotiations with selected candidates
  • managing confidentiality, commercially sensitive information, equal treatment and transparency
  • closing negotiations and inviting final tenders

Q&A session

Participants will have an opportunity to raise questions and discuss how the Competitive Procedure with Negotiation could be applied to procurement challenges within their own organisations.
